Terms of Service

1. Acceptance of Terms

By accessing or using Zetta API ("the Service"), operated by Zetta Technologies ("we", "us", "our"), you ("the User") agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Zetta API provides AI-powered services including but not limited to: large language model (LLM) inference, music generation, image enhancement, video processing, text-to-speech, and speech-to-text. All services are accessed via API keys issued to registered users.

3. Credit System

• 1 credit = $1.00 USD. All services are priced in credits.
• Credits are non-refundable. Once purchased, credits cannot be exchanged for cash.
• Credits do not expire while your account remains active. After 12 months of inactivity, credits may be frozen. They are restored upon any new top-up or support request.
• Credit packages and bonus rates are listed on our Pricing page. We reserve the right to adjust packages with 48 hours' notice.
• All service prices reflect 1.2× upstream provider cost. Prices may change within 24 hours of upstream price changes.

4. Payments

• Payments are accepted via manual transfer (Telegram/WhatsApp), cryptocurrency (USDT TRC20), and Stripe (credit/debit card) where available.
• USDT payments require 6 block confirmations before credits are credited to your account.
• Stripe payments are processed instantly via webhook. Chargebacks will result in immediate account freeze and permanent ban.
• We are not responsible for delays caused by payment processors, blockchain networks, or banking systems.

5. Acceptable Use

You agree not to:

• Use the Service for illegal activities, including but not limited to fraud, money laundering, terrorism financing, or generating illegal content.
• Generate content that violates the laws of Venezuela, the United States, or your jurisdiction.
• Attempt to reverse-engineer, bypass rate limits, or exploit the Service's pricing system.
• Use automated scripts, bots, or scraping tools to access the Service without prior written permission.
• Create multiple accounts to exploit free credits, bonuses, or promotional offers.
• Resell or sub-license API access without an Enterprise agreement.
• Generate deepfakes, non-consensual intimate imagery, harassment content, or any content violating platform policies of upstream providers (OpenAI, Anthropic, Google, etc.).

6. Rate Limits

To ensure fair usage and platform stability, the following rate limits apply:

• 60 requests per minute per API key
• 1,000 requests per hour per user
• 10,000 requests per day per user
• We reserve the right to adjust limits or apply per-model quotas for high-cost models.

7. Account Termination

We reserve the right to suspend or terminate your account immediately, without refund, if you:

• Violate these Terms of Service
• Engage in fraudulent activity or payment chargebacks
• Use the Service to generate illegal, harmful, or prohibited content
• Attempt to circumvent rate limits, pricing, or security measures
• Resell API access without authorization

8. Intellectual Property

• Your content: You retain all rights to content you generate through the Service. We claim no ownership over AI-generated outputs.
• Our platform: Zetta API, its code, branding, design, and infrastructure are our exclusive property. You may not copy, modify, or redistribute them.
• AI model outputs: We make no warranty regarding the originality, accuracy, or non-infringement of AI-generated content. Users are responsible for verifying outputs before commercial use.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranty, express or implied. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of AI-generated outputs
• Availability of any specific AI model
• Fitness of outputs for any particular purpose

10. Limitation of Liability

To the maximum extent permitted by law, Zetta Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability is limited to the amount you paid us in credits during the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Zetta Technologies, its affiliates, and personnel from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Service.

12. Privacy

We collect only information necessary to provide the Service: email address, API usage data, and payment records. We do not sell user data. We do not train AI models on user prompts or generated content. Payment data is processed by third parties (Stripe, blockchain networks) and is not stored on our servers.

13. Governing Law

These Terms are governed by the laws of the Bolivarian Republic of Venezuela. Any disputes shall be resolved in the courts of Caracas, Venezuela. For international users, you agree to comply with all applicable local laws.

14. Changes to Terms

We may update these Terms at any time. Material changes will be announced via email or platform notification at least 7 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
